Private Training Establishment faces criminal charges

The New Zealand Qualifications Authority (NZQA) has commenced criminal prosecution proceedings against an unregistered private training establishment and its director.

The charges relate to alleged breaches of the Education Act 1989, including unapproved enrolment of international students, making false representations that the establishment had consent to assess against certain unit standards and that its courses were approved by NZQA, and unauthorised usage of protected terms such as ‘New Zealand’ to describe its courses.

NZQA Deputy Chief Executive (Quality Assurance) Dr Grant Klinkum said that these

legal proceedings are a result of NZQA’s quality assurance processes which identified concerns around the unapproved enrolment of international students, false representations regarding the nature of the courses offered, and unapproved use of protected terms.

“NZQA’s role is to ensure quality education is delivered to students and that New Zealand qualifications are robust, credible, and internationally recognised. We must take action in situations like this to protect the integrity of New Zealand’s qualifications so that students are gaining and using qualifications in which they have faith.

Interim name suppression

The unregistered private training establishment and its director currently have interim name suppression by order of the District Court. NZQA has appealed against the District Court’s decision to the High Court and is awaiting the High Court’s decision. Pending the outcome of the appeal, NZQA is unable to comment further.
